What if a strangulation survivor doesn't want to talk to or report the assault to law enforcement?

As anyone who has worked in the field of domestic violence, sexual assault, stalking, human trafficking, etc. knows, only a small percentage of victims report their abuse to law enforcement, let alone seek medical care for injuries.

 

For sexual assault victims, there is the route to have an anonymous SAFE kit collected and stored. This allows a victim to have access to the forensic evidence if they later choose to pursue prosecution of the offender.

 

As of January 2026, anonymous SKITs are not available in Oregon. A law does not exist that requires medical facilities to collect anonymous SKITs or law enforcement to store them.

 

This, combined with the currently unresolved issue of whether adult domestic strangulation patients in a medical facility are a mandatory report to police leaves many survivors with limited options to have an anonymous kit taken and held. A solution to this issue is anticipated in the near future.

 

Although an anonymous SKIT cannot be completed with non-reporting victims at this time, the medical facility should still conduct an exam, along with any imaging that is necessary. If the victim later chooses to pursue charges against their offender the prosecutors can subpoena their medical records. Some providers use the strangulation exam form and add that to the patient’s medical record.
